Terms and Conditions

1. AGREEMENT

​

1.1 These Terms and Conditions are presented on our website and attached to the confirmation invoice. The making of a booking will form a contract on these Terms and Conditions between the Guest and The Old Mission Church owners for the holiday rental of the Property. “The Guest” means the person who makes the Booking.

The contract binds The Guest & all the members of their party who are part of the booking. It is the guests responsibility to ensure that all members of their party accept the terms of the contract set out in these terms & conditions. Failure to disclose all relevant information or comply with these terms may lead to termination of the contract & loss of the booking.

We require the name and contact details of The Guest including their email, postal address and phone number.


1.2 The Old Mission Church owners permits the Guest and their party to occupy the Property for the holiday period shown in the confirmation invoice together with the use of its contents.


2. BOOKING AND PAYMENT TERMS

 

2.1 The total price for your booking (the “holiday price”), and the dates on which the holiday price is payable, will be set out in your confirmation invoice.
 

2.2 Bookings are confirmed once receipt of the balance 1/3 of the total cost have been received, unless the holiday is within 10 weeks of the booking date then the total cost of the holiday is required to make the booking. The balance is due 8 weeks prior to arrival.

 

2.3 The Guest may make a Booking by:

• Sending an email giving details of your Booking requirements to The Old Mission Church owners at enquiries@theoldmissionchurch.com

or 

• Booking online at www.theoldmissionchurch.com

 

2.4 If, when making your Booking, the start date of your proposed Rental Period is more than 8 weeks away, The Guest must pay a non-refundable deposit to The Old Mission Church owners.
This deposit is one third of the Rental Fee. The balance of the Rental Fee is payable 8 weeks before the start of the Rental Period.

 

2.5 The entire Rental Fee is payable at the same time as your Booking if the Booking is made 8 weeks or less before the start of the Rental Period.
 

2.6 The Old Mission Church owners reserves the right to cancel your Booking at any time and retain the deposit if the balance is not received by the due date.
 

2.7 The Old Mission Church owners will issue a Booking confirmation to the Guest once you have successfully completed our booking process and in all cases all money due at the time of Booking has been received in cleared funds. The Guest should check the confirmation form carefully and notify The Old Mission Church owners immediately in case of any discrepancy or mistake.
 

2.8 The Old Mission Church owners may at any time before issuing a Booking confirmation form accept bookings from Agents or other customers for the Old Mission Church.
 

2.9 If The Old Mission Church is unavailable for the selected Rental Period and The Old Mission Church owners is unable to accept the Booking for this or any other reason, The Old Mission Church owners will return all money received from the Guest in full. 

 

3 METHODS OF PAYMENT 

 

3.1 The Guest should pay by BACS. Payment may be made by Credit or Debit Card if the facilities are available at the time of the booking, and are available in the country the payment is being made from. 

 

3.2 For Bookings made less than 3 weeks before the start date of the Rental Period, no credit card payments will be accepted, as payments must be made in cleared funds, i.e. by debit card or BACS.

4. CANCELLATION

 

4.1 If the Guest cancels the accepted confirmed Booking for any reason, the Guest must notify The Old Mission Church owners in writing at the address stated in these Booking Conditions (section 16.6).

 

Cancellation takes ​effect on the day we receive the Guest’s written notification. If The Old Mission Church is rebooked we will reimburse the Guest to the value of the re booking up to funds paid.

 

4.2 A cancellation charge is payable depending on the number of days (or part thereof) before the Rental Period start date that the notice of cancellation is received by The Old Mission Church owners. The amount payable is set out below, where number of days refers to the number of days notice given at cancellation prior to Rental Period start date, and the Cost refers to the percentage of the Rental Fee of The Old Mission Church:

4.3 Please note that should a cancellation be made The Old Mission Church owners shall be entitled to retain sums received from the Guest in accordance with further condition 5.5.
 

4.4 If The Old Mission Church becomes unavailable or unusable for any reason prior to the start of the Rental Period, the Guest will be reimbursed any sums received in respect of the Contract.
 

4.5 The Old Mission Church owners strongly recommends that Guests purchase holiday cancellation insurance, in order to protect against unavoidable eventualities preventing them from taking their holiday, such as serious illness, bereavement, loss of employment, weather conditions preventing travel etc. 


​5. THE OWNER'S RIGHT TO REFUSE/ALTER

 

5.1 The Old Mission Church owners may, at their discretion, refuse any booking.

 

5.2 The Old Mission Church owners reserve the right to refuse Bookings from: a) groups of people under the age of 21; and/or b) hen or stag parties. You must inform The Old Mission Church owners at the time of Booking if your party falls in condition 5.2(a) and/or 5.2(b).


5.3 The Old Mission Church owners may cancel or alter arrangements made for the Guest whether before or during the holiday period provided that such cancellation or alteration is necessary:
 

5.3.1 due to circumstances beyond the reasonable control of The Old Mission Church owners or
 

5.3.2 to perform or complete essential remedial or refurbishment works
 

5.4 If a booking is altered or cancelled by The Old Mission Church owners, they will take reasonable steps to offer a suitable alternative booking date.
 

5.5 If The Old Mission Church owners are not able to offer such an alternative or the Guest does not accept the alternative dates offered, The Old Mission Church owners will return to the Guest the relevant proportion of the holiday price paid by the Guest to The Old Mission Church owners in respect of the property and will not otherwise be liable for any additional loss caused by such alteration or cancellation.
 

6. CHANGE OF BOOKING

 

6.1 The Old Mission Church owners will endeavour, but is under no obligation, to consider a request from the Guest to change the Rental Period after it has been confirmed and accepted. Such a request will only be accepted if: 

• the Property is available for the new rental period requested

• the Guest pays an administration fee of £42.00

• the Guest accepts any adjustment to the rental costs (either up or down) for the new dates. 

 

6.2 Changes to bookings will not normally be accepted within one month of the Guest’s holiday, or from one calendar year to another.


7. OCCUPANCY & MAXIMUM NUMBER OF GUESTS

 

7.1 Occupation must be limited to the maximum number of 4 persons using the available beds only — sleeping on the sofas or in sleeping bags or camp beds is not allowed. 


7.2 As such any over-occupancy is considered to be a serious infringement of the Terms and Conditions and can result in an immediate requirement to vacate the premises, with no refund of monies due, and possible further charges in the event of damage to the facilities caused by excess usage.
 

7.3 The Agreement is personal to the Guest. The Guest must not use the Property except for the purpose of a holiday by the Guest and the Guest's party for the duration of the rental period and not for any other purpose or longer period.

 

7.4 The Guest agree that The Old Mission Church will not be used for any commercial purposes without the written consent of The Old Mission Church owners. 


7.5 The Old Mission Church owners will however always give reasonable consideration to specific requests for use of the Property which may relate to occupancy (for example, a function or celebration).
 

7.6 If the Guest wishes to hold any function or celebrations exceeding the occupancy limit it must first obtain the written permission of The Old Mission Church owners. If permission is granted an additional charge may be made.


8. SERVICES

 

8.1 The holiday price will include all charges for broadband, TV licence, water, electricity, and heating fuel.

 

9. LIABILITY AND LOSS OF GUEST PROPERTY

 

​9.1 Any Guest’s property found at The Old Mission Church will be subject to The Old Mission Church owner’s Policy:

 

9.2 Lost property will normally be disposed of if it is not collected within 6 months and The Old Mission Church owners may charge a reasonable administration fee to cover the costs of storage and handling of lost property.
 

9.3 The Old Mission Church owners will not be liable for any loss of property or any other loss or damage caused by it or its agents or contractors:
 

9.3.1 unless it has breached a legal duty of care owed to, or contractual term for the benefit of, the claiming party
 

9.3.2 where such loss or damage is not a reasonably foreseeable result of any such breach; or
 

9.3.3 where such loss or damage results from a breach by the claiming party of any duty of care owed to, or contractual term for the benefit of The Old Mission Church.

 

9.4 Nothing in these Booking Conditions shall limit or exclude the liability of The Old Mission Church owners for death or personal injury resulting from its negligence or for fraudulent misrepresentation or for any liability which cannot be excluded by law. 

 

9.5 Subject to condition 9.4 all warranties, conditions and other terms implied by statute or common law are, to the extent permitted by law, excluded from the Contract.

 

9.6 Subject to condition 9.4 The Old Mission Church owners shall not be liable for any actual or alleged indirect or consequential loss howsoever arising suffered by the Guest, or for any loss (either direct or indirect) of profits, anticipated profits, savings, business or opportunity or loss of publicity or loss of reputation or opportunity to enhance reputation or any other sort of economic loss. 

 

9.7 Subject as stated in condition 9.4 the aggregate liability of the The Old Mission Church owners to the Guest for breach of contract, misrepresentation, in tort or otherwise arising under or in connection with the Contract shall be limited to damages not exceeding three times the total amount of the Rental Fee received from the Guest.

​10. PETS

​

10.1 Guests are allowed to bring a maximum of 2 dogs to The Old Mission Church. There is a charge of £25 each to help cover the cost of additional housekeeping. No other kinds of pets are allowed.

 

10.2 Please make sure that your dog/s is not left alone in the Property for any period of time unless left in a dog crate.
 

10.3 Dogs are not allowed in the bedrooms or upstairs and are to be kept off all the furniture within The Old Mission Church.
 

10.4 You are strongly advised to keep your dog/s on a lead at all times within the patios / gardens of The Old Mission Church due to the risk posed by the proximity to the road.

 

10.5 The Old Mission Church is surrounded by a field that is occasionally occupied by sheep, which may be grazing or be pregnant or have lambs. Whilst on the premises of The Old Mission Church, dogs must be kept under strict control and not allowed to disturb the sheep or lambs, doing so will constitute a breach of the Agreement by the Guest.

 

10.6 Registered guide and hearing dogs belonging to those with visual and hearing impairments are allowed in The Old Mission Church at no extra charge. 

 

10.7 Guests with allergies should be aware that The Old Mission Church owners cannot guarantee that there have been no dogs in the Property, nor (subject to condition 9.4) does the Owner accept any liability for any suffering which may occur as a result of such pets having been present. 


11. THE OLD MISSION CHURCH OWNERS RIGHT OF ENTRY

 

11.1 As with any Property, there is a need for ongoing and occasionally unforeseen work in The Old Mission Church. The Old Mission Church owners and its contractors may enter the Property at any reasonable time for reasonable cause. This includes the need to undertake inspections and audits necessary to operate the business, the undertaking of unforeseen (internal and external) remedial repairs together with any annual external repairs for which access to the inside of the Property may be required. External windows and doors may be opened during this process.
 

11.2 The Old Mission Church Owners will give the Guest reasonable notice of such requirements and aims to restrict the working hours of our contractors to between the hours of 09.00 — 17:00.

12. GUEST OBLIGATIONS

 

12.1 The Guest will be responsible for all payments and for any damage whether caused by the Guest or his or her party. The Guest agrees to make his or her party aware of these Terms and Conditions.

 

12.2 The Guest must ensure that The Old Mission Church is left in a clean and tidy condition on your departure at the end of the Rental Period (including cleaning up after any animals which you have been permitted to bring to the Property). The Old Mission Church owners may charge The Guest for the reasonable costs of any additional cleaning if this is reasonably considered necessary. 


12.3 The Guest must allow The Old Mission Church owners and/or its agents to enter the property to inspect the state of it, on reasonable notice, except in emergency when immediate access must be granted.
 

12.4 The Guest must not use the Property or allow its use for any dangerous, offensive, noisy, illegal or immoral activities that may be a nuisance or annoyance to The Old Mission Church owners or to any neighbours.
 

12.5 The Old Mission Church owners will not tolerate any verbal or physical abuse towards themselves or any staff or representatives.
 

12.6 Smoking of tobacco in any form or E-cigarettes is not permitted in any part of The Old Mission Church and the Guest and any member of his or her party agrees not to smoke inside the Property.
 

12.7 The use of candles or fireworks by the Guest or his or her party at the Property is strictly not permitted unless expressly agreed in writing with The Old Mission Church owners.
 

12.8 Guests must accept responsibility for their pets safety.


​13. DAMAGES AND SECURITY CHARGE

​

13.1 The Old Mission Church Owners recommend that Guests hold personal insurance for accidental damage and personal liability.


13.2 If on arrival at the Property you discover that anything is missing or damaged then this must be reported to The Old Mission Church Owners immediately otherwise it will be presumed that the damage/loss was caused by the Guest and a charge will be made.
 

13.3 A Damage Waiver fee of £18 is included in your booking fee. This policy means the costs of making good any loss or damage to the selected Property and/or its contents caused through act or omission of the Guest, any of your party or accompanying animals up to £18 will not be recoverable from the Guest. This amount will be specified in the booking confirmation. Where any such damage so caused exceeds this amount, The Guest agrees to pay to The Old Mission Church owners, upon written demand, any reasonable costs incurred in making good any such loss or damage above the predetermined amount. 

The Old Mission Church Owners reserves the right to take up to 21 days to evaluate the damage and undertake the necessary work required.

 

14. UTILITY SUPPLY

 

14.1 The Old Mission Church owners cannot accept responsibility for loss or intermittent supply of water, fuel, electricity or broadband services at the Property where this is as a result of a drought, an act or omission of the relevant supply company or for any other reason outside of The Old Mission Church owners’ reasonable control.

 

15. WEATHER

15.1 If the Property becomes inaccessible due to bad weather The Old Mission Church owners will take reasonable steps to inform the Guest. However, The Old Mission Church owners’ liability does not extend to weather related conditions that affect public roads.


16. COMMENTS/COMPLAINTS

 

16.1 Every reasonable care will be taken to ensure that The Old Mission Church is presented to Guests to a high standard. Should the Guest find on arrival that there is a problem or cause for complaint, the Guest should immediately contact The Old Mission Church owners. 

All reasonable steps will then be taken to assist the Guest.
 

16.2 The Old Mission Church owners are committed to ensuring that any problems or complaints the Guest may have whilst at the Property are resolved efficiently and promptly, but as such must be given the opportunity to do so. Any refusal to notify The Old Mission Church owners immediately or refusal of reasonable rectification may affect the Guest’s right to compensation.
 

16.3 Guests must provide a contact telephone number and suitable time for The Old Mission Church Owners to communicate with them about problems or complaints.
 

16.4 Guests must allow access to the Property by any staff or contractors of The Old Mission Church owners to resolve problems or complaints.
 

16.5 The Guest must not independently move to other Property without first allowing The Old Mission Church owners the reasonable opportunity to assist in resolving the complaint or problem. If the Guest does so, or refuses reasonable rectification, the Guest may affect their rights to compensation.
 

16.6 Guests must formally confirm any unresolved complaint in writing; by telephone or by email to The Old Mission Church Owners within 28 days of returning from the holiday.

16.7 The Old Mission Church owners do not warrant and are not responsible for the accuracy of any verbal information given or statements made by any of its representatives or agents.


17. ARRIVAL AND DEPARTURE TIMES

 

17.1 The Guest and his or her party must arrive after the arrival time (4.00pm on the first day of the holiday period) and depart before the departure time (10:00am on the last day of the holiday period).
 

17.2 Any stay that extends over this period may be subject to a charge being made for additional days.
 

17.3 The Guest will be issued with a key (either by hand or from the Key Safe) to The Old Mission Church on the first day of the holiday period and the Guest must return them (either by hand or into the Key Safe) on the last day of the holiday period or the date of departure, if earlier. 

Failure to return the keys promptly will incur the cost of a replacement set of £30. 

 

18. RURAL WAY OF LIFE

 

18.1 The Old Mission Church is in a rural location and can experience some animal noise and occasionally noise from grass cutting or other farm machinery or activities. Please also note condition 10.5 with respect to the control of dogs whilst they are staying in the Property.

 

18.2 Flora and fauna: In rural areas, insects and other creatures are fairly common and not necessarily an indication of poor housekeeping standards. Whilst preventative action is always taken by The Old Mission Church owners and its agents these creatures can never be eradicated completely. 

19. RIGHT TO EVICT

 

19.1 The Old Mission Church owners may terminate the Agreement on notice and in such case the Guest and his or her party must leave the Property (without compensation being payable to the Guest or any member of his or her party) if:


19.1.1 this is deemed necessary by The Old Mission Church owners where there is a serious breach by the Guest of the Agreement or the Guest’s or his or her ​party’s behaviour endangers the safety of others;
19.1.2 or any complaints are made of anti-social, unacceptable behaviour or unreasonable breakages or damage or smoking or pet restrictions are not observed.

20 DATA PROTECTION 

​

20.1 For the purposes of this clause, capitalised terms not defined elsewhere in this Contract shall have the meaning set out in the Data Protection Legislation. 

The Old Mission Church owners are Data Controllers of all Personal Data provided to The Old Mission Church ownersby the Guest. 

​

20.2 The Old Mission Church owners will comply with the Data Protection Legislation and any directions issued by the Information Commissioner in the processing of such Personal Data.
 

20.3 To the extent that The Old Mission Church owners is a Processor, the Guest agree that The Old Mission Church owners may Process the relevant Personal Data and may need to pass The Guests Personal Data on to third parties and organisations who need to know them so that the Booking can be provided.
 

20.4 When acting as a Processor, in relation to the Booking and the Contract, The Old Mission Church Owners shall:

20.4.1 Process the Personal Data only to the extent necessary for the purpose of providing the services and in accordance with any written instructions from the Guest and this Clause 20;

 

20.4.2 implement and maintain appropriate technical and organisational measures in accordance with the Data Protection Legislation to ensure a level of security appropriate to the risks that are presented by such Processing, in particular from accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or access to Personal Data, taking into account the state of the art, the costs of implementation, the nature, scope, context and purposes of Processing and the likelihood and severity of risk in relation to the rights and freedoms of the Data Subjects;

 

20.4.3 not transfer the Personal Data outside of the EEA unless adequate levels of protection are in place;

 

20.4.4 ensure that any employees or other persons authorised to Process the Personal Data are subject to appropriate obligations of confidentiality;

 

20.4.5 not engage any third party to carry out its Processing obligations other than by way of a written contract which confirms that such third party will, at all times during the engagement, be subject to Processing obligations which comply with the Data Protection Legislation;

 

20.4.6 as soon as reasonably possible and without undue delay notify the Guest about any request (including subject access requests) or complaint received from Data Subjects without responding to that request (unless authorised to do so by the Guest) and assist the Guest by technical and organisational measures, insofar as possible, for the fulfilment of your obligations in respect of such requests and complaints at its then-current rates;

 

20.4.7 notify the Guest without undue delay as soon as The Old Mission Church owners becomes aware of any relevant breach in data security;

 

20.4.8 maintain appropriate records and information in compliance with Data Protection Legislation and on request by the Guest, make available such records and information 

​

21. GOVERNING LAW

 

20.1 The construction, validity and performance of the Agreement shall be governed by the law of England and Wales, and both parties submit to the non-exclusive jurisdiction of the UK Courts.
